Smoking Barrel Terms and Conditions
1. Definitions
"Client": The individual or organisation commissioning photography, videography, or related services from Smoking Barrel or guests submitting their email address via the signup form to receive images.
"Deliverables": All products resulting from the Services, including videos, photos, and any related digital content.
"Job": Any assignment, project, or set of tasks undertaken by Smoking Barrel on behalf of the Client.
"Media": Footage, video, images, raw photos, or other digital content captured by Smoking Barrel during an event or shoot.
"Services": All activities Smoking Barrel is contracted to perform for the Client, including but not limited to ground-based photography and videography, and limited drone operations.
2. Introduction
Smoking Barrel is a professional fieldsports photography and videography company specialising in capturing the essence of sporting events through high-quality imagery and film. While the majority of our work involves ground-based filming, drones may be used for aerial shots in certain circumstances. Smoking Barrel operates under the highest safety standards and always complies with UK Civil Aviation Authority (CAA) regulations where drones are involved.
By either employing Smoking Barrel’s services or submitting your email address through our signup form and agreeing to the terms, you consent to these Terms and Conditions.
3. Copyright and Usage Rights
Smoking Barrel retains all rights, title, and interest in the copyright of the images and media provided. Clients are granted a limited, non-exclusive licence to use the images for personal purposes such as sharing on social media, printing, and private sharing.
Clients are not permitted to sell, license, or otherwise commercialise the images or footage without express written permission from Smoking Barrel. The images must not be shared with the press or used for any commercial purpose without prior approval.
4. Stock Footage and Model Release
Smoking Barrel reserves the right to sell any images or footage captured for use as stock footage. By accepting the images, clients agree to a model release, allowing the use of their likeness for any commercial purpose if they are recognisable in the media. Clients who wish to withdraw this consent must contact Smoking Barrel at the address or email provided.
By accepting the images, clients grant Smoking Barrel the right to use their likeness for commercial purposes if they are recognisable in the media. Clients further authorise Smoking Barrel to sign a model release on their behalf, where required, for the use of such images or footage as stock footage.
5. Ground Photography and Videography
Smoking Barrel specialises in high-quality ground photography and videography for fieldsports events. The images and videos will be captured in a manner that reflects the authentic nature of the event, with attention to composition, lighting, and key moments of the day.
Clients must ensure that all relevant permissions have been secured for photography and filming at the event location and that access to areas is unhindered.
6. Drone Operations (When Applicable)
Smoking Barrel adheres to all regulations set out by the Civil Aviation Authority (CAA) for drone operations.
- Pilot Authority: The Pilot in Command (PIC) has the final decision regarding the safety of any drone flights. If weather or airspace restrictions prevent the drone from flying, alternative plans will be discussed, but the pilot’s decision is final.
- Drone Interference: Any individual attempting to interfere with the drone, including shooting at it or otherwise causing it to fall from the sky, will be reported to the CAA and may face an investigation for endangering an aircraft. In such an event, the responsible party will be liable for:
- Full payment for the replacement of the drone at the original purchase price.
- Compensation for any lost business or income during the period the drone is out of service.
- Any additional costs related to legal actions or investigations.
Clients must provide sufficient notice if drone usage is required and notify Smoking Barrel of any local restrictions or requirements.
7. Use in Smoking Barrel Marketing
By accepting images from Smoking Barrel, clients agree to allow their image, likeness, and activities to be used in Smoking Barrel's marketing, including social media and promotional materials. Clients wishing to withdraw this consent must contact Smoking Barrel in writing.
8. Responsibilities
Client Responsibilities: Clients must ensure the site for photography or videography is safe and accessible. All necessary permissions for filming or drone operations must be secured.
Smoking Barrel Responsibilities: Smoking Barrel will perform all services with professionalism and high-quality standards, ensuring that the final deliverables reflect the nature of the shoot and meet the agreed brief.
9. Liability and Indemnification
Smoking Barrel will not be held liable for any delays or damages caused by unforeseeable events such as weather conditions, restrictions, or access issues. The client agrees to indemnify Smoking Barrel from any third-party claims arising from their own actions during the event.
10. Cancellation Policy
Client Cancellation: Cancellations due to weather or unforeseen access restrictions may be made without penalty. Cancellations within 48 hours of a job that are not weather-related will incur a 50% fee, and cancellations on the day of the job will be charged at 100%.
Smoking Barrel Cancellation: Smoking Barrel reserves the right to reschedule jobs due to safety concerns, regulatory restrictions, or adverse weather and will work with the client to find a suitable alternative date.
11. Payment Terms
Invoices are due within 30 days of issuance unless otherwise agreed in writing. Late payments will incur a 10% fee per month.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of the United Kingdom. Any disputes shall first be attempted to be resolved through mediation, with further legal proceedings handled in UK courts.
